Arbitration: Any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the Arbitration Act (Ontario). The arbitration shall be conducted in English by a single arbitrator in Toronto, Ontario. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.

Exception: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.
